Maine Maritime Museum Cruise Season Pass Program

Terms and Conditions

1. Eligibility and General Use

1.1 Eligibility. Cruise Season Passes (“Season Passes”) are available exclusively to current members of Maine Maritime Museum (the “museum”) who are age 18 or older.

1.2 Daily Usage Limit. Season Pass holders may reserve and attend a maximum of one (1) cruise per calendar day, subject to the guest allowance associated with the applicable pass type.

1.3 Pass Holder Presence. The named Season Pass holder must be physically present on board the vessel for the full duration of each cruise. All guest privileges are valid only when the pass holder is in attendance. The museum reserves the right to request valid photo identification at check-in and/or boarding.

1.4 Guest Policy. Guests included under a Season Pass must be accompanied by the named passholder. Any additional guests beyond the allowance of the applicable pass type will be subject to standard ticket pricing unless otherwise specified by the museum.

1.5 Failure to Appear. Repeated failure to appear for reserved cruises without prior cancellation (“no-shows”) may be considered misuse of Season Pass privileges and may result in restrictions or revocation of benefits.

2. Exclusions and Blackout Dates

2.1 Exclusions. Season Passes are not valid for specialty cruises, including oyster cruises, fireworks cruises, and privately chartered events.

2.2 Blackout Dates. Season Passes may not be used on designated museum special event dates, including July 10, July 17, and July 18. The museum reserves the right to designate limited (not more than three) additional blackout dates with reasonable notice.

3. Reservations and Cancellations

3.1 Reservation Policy. Advance reservations are encouraged; however, both advance reservations and walk-up use are subject to vessel capacity and operational availability. The museum reserves the right to limit the number of active or rolling reservations held by any individual Season Pass holder.

3.2 Cancellations. Reservations must be canceled no less than sixty (60) minutes prior to the scheduled departure time. Failure to cancel within this timeframe may be considered a no-show.

4. Revocation and Misuse of Benefits

4.1 Right to Revoke. The museum reserves the right, in its sole discretion, to suspend or revoke Season Pass privileges at any time, without refund, in cases of misuse, abuse, unsafe conduct, repeated no-shows, or violation of these Terms and Conditions.

4.2 Examples of Misuse. Prohibited conduct includes, but is not limited to:

  • Commercial Use. Use of Season Passes for business purposes, resale, or third-party bookings. Corporate entertaining is permitted only when the named Season Pass holder is present.

  • Fraudulent Activity. Attempting to utilize Season Pass benefits without the pass holder present.

  • Disruptive Behavior. Failure to comply with crew instructions, museum policies, or applicable safety regulations.

4.3 No Refunds. No refunds or credits will be issued in the event of suspension or revocation due to misuse.

5. General Terms

5.1 Non-Transferability. Season Passes are non-transferable and may not be shared, assigned, or resold (For those holding season passes that allow additional guests the guests may vary).

5.2 No Cash Value. Season Passes have no cash value and may not be redeemed for cash or credit.

5.3 Operational Changes. Cruise schedules, vessel assignments, and availability are subject to change due to weather conditions, maintenance requirements, operational considerations, or private events.

5.4 Trip Cancelations. In the event the museum cancels a trip due to unforeseen circumstances such as weather you may reschedule to another available date but refunds will not be issued.

5.6 Extended Cancelations Refunds. In the event the museum cancels cruises for an extended period (two weeks or more) and does not resume cruise operations before the end of the season, the museum may, at its discretion, issue a partial refund or museum credit. Any such refund or credit may take into account the standard retail value of cruises already redeemed under the Season Pass prior to the cancellation.

By purchasing or using a Season Pass, the holder agrees to abide by these Terms and Conditions as established by Maine Maritime Museum.

Merrymeeting Terms & Conditions

Merrymeeting is a 56′ motor vessel with a covered lower deck and open upper deck. Cruises run in light rain and other moderate weather conditions. Cruises may be cancelled in the event of severe or unsafe weather conditions or unmet minimum ticket sales, and cancellations are made by the Captain on the day of the cruise. If the Museum cancels a cruise, you will have the opportunity to reschedule.

Accommodations & Policies

  • Accessible restrooms are located in the Maritime History Building and Visiting Yachtsman’s Building. Changing tables are available in all of the museum’s restrooms.

  • Wheelchairs are available for loan from Visitor Experience.

  • Service animals are welcome, but pets and support animals are restricted to the south end of campus and not permitted in any building. Dogs must be leashed; please clean up after your pet.

  • Maine Maritime Museum is a smoke-free campus.

  • While visiting the museum you may be photographed or filmed, and footage may be used in promotional materials.

TIME LIMITATIONS – NOTICE:

TIME LIMITATION — PERSONAL INJURY — DEATH CLAIMS: MAINE MARITIME MUSEUM shall not be liable for any claim for loss of life or personal injury unless made in writing and lodged with Maine Maritime Museum at its office AT BATH, MAINE within six (6) months from the date when the death or injury occurred.

SUITS: SUITS AND ACTIONS TO RECOVER FOR LOSS OF LIFE OR PERSONAL INJURY TO PASSENGERS SHALL NOT BE MAINTAINABLE UNLESS INSTITUTED WITHIN ONE (1) YEAR FROM THE DATE WHEN DEATH OR INJURY OCCURRED. SUITS AND ACTIONS TO RECOVER FOR CLAIMS OTHER THAN PERSONAL INJURIES OR LOSS OF LIFE SHALL NOT BE MAINTAINABLE UNLESS COMMENCED WITHIN SIX (6) MONTHS FROM THE DATE WHICH THE CLAIM ACCRUED OR LOSS OCCURRED. FORUM FOR BRINGING ACTIONS FOR PERSONAL INJURY OR DEATH: IT IS AGREED BY AND BETWEEN THE PASSENGER AND MAINE MARITIME MUSEUM THAT ALL CLAIMS, DISPUTES AND MATTERS WHATSOEVER ARISING UNDER, IN CONJUNCTION WITH, OR RELATING TO THIS CONTRACT AND THE TRANSPORTATION FURNISHED HEREUNDER, SHALL BE COMMENCED, FILED AND LITIGATED, IF AT ALL, IN AND BEFORE THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MAINE LOCATED IN PORTLAND, STATE OF MAINE, U.S.A., TO THE EXCLUSION OF THE COURTS OF ANY OTHER STATE, TERRITORY, OR COUNTRY. [46 USC §30508(b)];

LIMITATION – DAMAGES FOR EMOTIONAL, MENTAL OR PSYCHOLOGICAL INJURIES:

IT IS AGREED BY AND BETWEEN THE PASSENGER AND MAINE MARITIME MUSEUM THAT NEITHER THE OWNER, OPERATOR, NOR ANY CREWMEMBER, MANAGER, AGENT OR MASTER OF THE VESSEL SHALL BE LIABLE FOR THE INFLICTION OF EMOTIONAL DISTRESS, MENTAL SUFFERING, OR PSYCHOLOGICAL INJURY SUFFERED BY THE PASSENGER UNLESS SUCH EMOTIONAL DISTRESS, MENTAL SUFFERING, OR PSYCHOLOGICAL INJURY WAS:

(A) THE RESULT OF PHYSICAL INJURY TO THE PASSENGER CAUSED BY THE NEGLIGENCE OR FAULT OF A CREWMEMBER OR THE MANGER, AGENT, MASTER, OWNER, OR OPERATOR;

(B) THE RESULT OF THE PASSENGER HAVING BEEN AT ACTUAL RISK OF PHYSICAL INJURY, AND SUCH RISK WAS CAUSED BY THE NEGLIGENCE OR FAULT OF A CREWMEMBER OR THE MANGER, AGENT, MASTER, OWNER, OR OPERATOR; OR

(C) INTENTIONALLY INFLICTED BY A CREWMEMBER OR THE MANGER, AGENT, MASTER, OWNER, OR OPERATOR.
